Commercial regulation: effectiveness and social compliance in Australia
BLT participants: Mark Bender, Roger Gamble, Wayne Gumley, Michelle Welsh
Outline
- Mark Bender is investigating ways to monitor and control email spam and the underestimation of auction sale prices by the real estate industry. He is also assessing compliance with consumer protection regulations by a representative sample of Victorian retailers.
- Roger Gamble is investigating the effectiveness of the ACCC’s anti-cartel investigative and enforcement initiatives with particular emphasis on the effect of (a) leniency programs and (b) the imminent criminalisation of ‘hard core’ cartel activity.
- Wayne Gumley is devising a de-centred regulatory system to improve compliance with environmental policy.
- Michelle Welsh is evaluating the factors that inform ASIC’s choice of civil or administrative penalties under the Corporations Act 2001 (Cth) and comparatively assessing whether these regulatory regimes have effectively remedied contraventions of the Corporations Act 2001 (Cth).
