Corporate law reform in Malaysia: challenges and responses to globalisation

23 February 2007

A Corporate Law Reform Committee, set up under the auspices of the Companies Commission of Malaysia, is presently undertaking a comprehensive review of the legal and regulatory corporate framework in Malaysia.

The objectives of the corporate law reform program are:

  • the creation of a legal and regulatory structure that will facilitate business
  • the promotion of accountability and protection of corporate directors and members taking into account the interests of other stakeholders in line with international standards.

This presentation gives an insight into the approach taken by the Corporate Law Reform Committee (CLRC) in its process of modernising corporate law in Malaysia.

It highlights the role of corporate law reforms in other jurisdiction such as the United Kingdom, Australia, New Zealand and Hong Kong in providing important benchmarks in determining changes and responses to corporate law reform in Malaysia.

It also discusses legal issues arising from the documents which have been issued for public consultation.
